The College of Policing and the National Police Chiefs’ Council have issued fresh guidelines to officers urging them to ‘only enforce what is written in law.’
The guidance specifically says there are no laws to enforce the current two-metre distancing advice, avoiding public transport or the wearing of face coverings in enclosed spaces.
The advice, set out in a document sent out to police forces on Tuesday night, follows updated legislation which came into force at 12.01am yesterday..
Referring officers to the updated law in England for more information, the notice reiterates: “People are still not allowed to leave or be outside of their homes without a reasonable excuse.
“The regulations update the list of examples of reasonable excuses, but officers’ judgment and discretion are key – apply the four Es (engage, explain, encourage, enforce).”
While restrictions on gatherings can be enforced, a reminder was given to the increased fines someone will receive, if police believe they are flouting restrictions on movement amid the coronavirus outbreak, will be lowered to £50 if paid within 14 days, according to the Home Office.
Fines will double for each repeat offence, up to a maximum of £3,200.
The document adds: “Enforcement is a last resort.”
